1. Introduction and Acceptance

This Distance Sales Agreement (the "Agreement") governs the sale of books and related products through the Book Hub online store operated by FibreHub Inc. ("we," "us," "our," or "Book Hub"). By placing an order through our website, you (the "Customer" or "you") agree to be bound by the terms and conditions set forth in this Agreement.

This Agreement complies with the Consumer Protection Act of Quebec, the Personal Information Protection and Electronic Documents Act (PIPEDA), and applicable Canadian consumer protection legislation.

2. Definitions

"Business Day" means any day other than Saturday, Sunday, or a statutory holiday in Quebec, Canada.

"Customer" means any person who places an order for products through the Book Hub online store.

"Order" means a request by the Customer to purchase products from Book Hub.

"Products" means books, e-books, audiobooks, and related merchandise offered for sale on our website.

"Website" means the Book Hub online store and all associated web pages and platforms.

3. Products and Pricing

3.1 Product Information

We make every effort to display accurate product information, including descriptions, images, prices, and availability. However, we do not warrant that product descriptions or other content on the Website is accurate, complete, reliable, current, or error-free.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

3.2 Pricing

All prices are displayed in Canadian Dollars (CAD) unless otherwise specified. Prices are subject to change without notice. The price charged for a product will be the price displayed on the Website at the time you submit your order, subject to the terms set forth below.

Prices do not include applicable taxes, shipping, handling, or other fees, which will be added to your order total at checkout.

3.3 Pricing Errors

If we discover a pricing error after you have placed an order, we will notify you as soon as possible and give you the option to either confirm your order at the correct price or cancel your order for a full refund.

4. Order Process

4.1 Placing an Order

To place an order, you must:

  • Select the products you wish to purchase
  • Add them to your shopping cart
  • Proceed to checkout
  • Provide accurate delivery and payment information
  • Review and confirm your order

4.2 Order Confirmation

After you place an order, you will receive an email confirmation containing your order details. This confirmation does not constitute our acceptance of your order, but merely confirms that we have received it.

A contract between you and Book Hub will be formed when we send you a shipping confirmation email indicating that your order has been dispatched.

4.3 Order Acceptance and Refusal

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud or unauthorized transactions, or if we believe the order violates this Agreement or applicable law.

5. Payment Terms

5.1 Payment Methods

We accept the following payment methods:

  • Credit Cards (Visa, MasterCard, American Express)
  • Debit Cards
  • PayPal
  • Interac e-Transfer

5.2 Payment Authorization

By providing payment information, you represent and warrant that:

  • You are legally authorized to use the payment method provided
  • The information you provide is accurate and complete
  • You have sufficient funds or credit available to complete the purchase

5.3 Payment Processing

Payment will be charged to your account at the time your order is processed. All payments are processed securely through our payment service providers. We do not store your complete payment card information on our servers.

For Interac e-Transfer payments, you will receive instructions via email after placing your order. Your order will be processed once payment is received and verified.

5.4 Currency

All transactions are processed in Canadian Dollars (CAD). If you are using a payment method denominated in a different currency, your financial institution may charge currency conversion fees.

6. Delivery and Shipping

6.1 Delivery Regions

We currently ship physical products to addresses within Canada and the United States. Digital products (e-books and audiobooks) are available for download worldwide.

6.2 Delivery Timeframe

Standard delivery timeframes are as follows:

  • Physical Products: 3-7 Business Days from the date of shipment
  • Digital Products: Immediate access upon successful payment

Delivery times are estimates and may vary depending on your location, shipping carrier, weather conditions, customs clearance (for U.S. deliveries), and other factors beyond our control. We are not responsible for delays caused by the shipping carrier or force majeure events.

6.3 Shipping Costs

Shipping costs are calculated based on the size, weight, and destination of your order. The total shipping cost will be displayed at checkout before you complete your purchase. Free shipping may be offered on orders over a certain amount, as indicated on our website.

6.4 Order Tracking

Once your order has been shipped, you will receive a shipping confirmation email with tracking information. You can track your shipment using the tracking number provided through the carrier's website.

6.5 Delivery Address

You are responsible for providing an accurate and complete delivery address. We are not responsible for orders delivered to an incorrect address provided by you. If a shipment is returned to us due to an incorrect or incomplete address, we will contact you to arrange redelivery, which may incur additional shipping charges.

For U.S. deliveries, the recipient is responsible for any customs duties, import taxes, or brokerage fees that may apply.

6.6 Risk of Loss

Risk of loss and title for physical products pass to you upon delivery to the carrier. However, we will work with you to resolve any issues related to lost or damaged shipments.

7. Right of Withdrawal and Cancellation

7.1 Cancellation Period

In accordance with Quebec's Consumer Protection Act, you have the right to cancel your order within 10 days of receiving the goods without providing any reason and without incurring penalties or cancellation fees.

7.2 How to Exercise Your Right of Withdrawal

To cancel your order, you must inform us of your decision by:

Please include your order number and contact information in your cancellation notice.

7.3 Exceptions to Right of Withdrawal

The right of withdrawal does not apply to:

  • Digital products (e-books, audiobooks) once downloaded or accessed
  • Products sealed for hygiene reasons that have been unsealed
  • Custom or personalized products made to your specifications
  • Products that cannot be returned for health or hygiene reasons

7.4 Effects of Cancellation

If you cancel your order within the cancellation period, we will reimburse all payments received from you, including delivery costs (except for supplementary costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us). Refunds will be processed within 14 days of receiving your cancellation notice.

8. Returns and Refunds

8.1 Return Process

To return a product:

  • Contact us to initiate a return within the cancellation period
  • Pack the product securely in its original packaging (if possible)
  • Include a copy of your order confirmation or packing slip
  • Ship the product to the return address provided by our customer service team

8.2 Return Conditions

To be eligible for a return, products must be:

  • In new and unused condition
  • In the original packaging (where applicable)
  • Accompanied by proof of purchase

8.3 Return Shipping Costs

If you are exercising your right of withdrawal, we will cover the cost of return shipping. For returns outside the cancellation period (subject to our discretion), you will be responsible for return shipping costs unless the return is due to our error or a defective product.

8.4 Refund Processing

Once we receive and inspect your returned product, we will send you an email notification. If the return is approved, your refund will be processed to the original payment method within 14 days. Depending on your financial institution, it may take additional time for the refund to appear in your account.

8.5 Damaged or Defective Products

If you receive a damaged or defective product, please contact us within 10 days of delivery. We will arrange for a replacement or full refund, including shipping costs, at no additional charge to you.

9. Intellectual Property Rights

All content on the Book Hub website, including text, graphics, logos, images, and software, is the property of FibreHub Inc. or its content suppliers and is protected by Canadian and international copyright laws. Products sold through our store may be protected by copyright held by the publisher or author. Unauthorized reproduction or distribution is prohibited.

10. Limitation of Liability

10.1 General Limitation

To the fullest extent permitted by applicable law, Book Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

10.2 Maximum Liability

Our total liability to you for all claims arising out of or related to this Agreement or your use of our services shall not exceed the amount you paid for the specific product that is the subject of the claim.

10.3 Statutory Rights

Nothing in this Agreement excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under applicable law.

11. Privacy and Data Protection

Your privacy is important to us. The personal information you provide when placing an order is collected, used, and disclosed in accordance with our Privacy Policy and applicable privacy laws, including PIPEDA and Quebec's privacy legislation. By placing an order, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

12. Dispute Resolution

12.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

12.2 Jurisdiction

Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Quebec, Canada.

12.3 Alternative Dispute Resolution

Before initiating any legal proceedings, we encourage you to contact us to attempt to resolve any disputes amicably. You may also have the right to submit complaints to your local consumer protection authority.

13. Force Majeure

We shall not be liable for any failure to perform our obligations under this Agreement if such failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, epidemics, pandemics, or disruptions to transportation or communication networks.

14. Amendments to Agreement

We reserve the right to modify this Agreement at any time. Any changes will be posted on our website with an updated effective date. Your continued use of our services after such changes constitutes your acceptance of the modified Agreement. We encourage you to review this Agreement periodically.

15. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

This Agreement, together with our Privacy Policy and any other legal notices published on our website, constitutes the entire agreement between you and Book Hub regarding your use of our services and supersedes all prior agreements and understandings, whether written or oral.
